It could be i guess, but then the expansion of the material is not same as trying to pass the idea or material as your own.

Legally, there are also rules for sampling music which i think legally works to the same degree where you can use a predefined number of seconds or signature notes with out the need for permission unless it is a trademark phrase or slogan.

Its also polite to give credit where credit is deserved, and though not legally binded to do so, you might have more friends in the art world if you did.

When you go to the store and look at how many spatchulas there are. I could take the cheapest plastic one, and add a rubber grip and make it in a different color. It would still legally be considered my design.

By the way, the next person to say "grabbing at straws" owes me 20 bucks.
