COD shame?

Firstly, let me say that I do not have a copy of COD & have not played the game. My comments are related to my reading of the many forum posts on various boards from people who have purchased COD. I have checked the official game website & various promotional videos etc put out at various stages by the game distributer. There are claims made on the website & in promo material that appear to be untrue at the time of the game release. For example, COD promo proudly proclaims that pilots can join a 128 player online dogfight. To my knowledge this is not possible given the current engine performance issues. Secondly, the distributers claim on the official game website that the minimum computer specs below are required for the game. My understanding is that most users with high-end computers are experiencing unplayable FPS becuase the code has not been optimised to use multicore processers (uses just one core). Further, users with the minimum computer specs are experiencing lockups or FPS so low they compare the game to a slide show. Notwithstanding the usual game "bugs" that might be expected (issues that beta testers might have missed), it could be suggested that the game distributers material is misleading & perhaps even deceptive or contrary to various trade practices laws.
