Sorry for the misunderstanding

i don't see the problem... i think he was just being helpful (or trying to) and heck... in this day of overblown ego's, ultra-argumentitive bozo's, "ALWAYS about ME," gumps and "i'm always right," whack-jobs, being helpful (or trying to) is a darn 'GOOD' thing! we don't have "ENOUGH" people trying to be helpful.

:???:

and about this asking permission thing... everyone here that has changed, modified, uploaded, download, added and or taken away 'something' from IL2/1946 and 'personally' ASKED the 'rightful and legal' owner/creator of this wonderful game, Oleg Maddox, "BEFOREHAND"... please raise your hand!

ah... not that many hands coming up, eh?

didn't think so. but then again THAT shoe is ALWAYS on the other foot, eh? always the ole "ok for me to do it" but not someone else.

sure it is...

go figure.

I'm with you, I could see if it was being sold for profit but modding? I could make something or fix it, I could care less if someone else takes it and adds to it or
makes it better. I thought that was what modding was all about; toot toot.

correct me if i'm wrong but didnt he post a link to each individual mod's source page - be it AAA or UP etc ?

that to me is indicates who made what - i was never under any impression Pablo had made these mods , just that he'd made a compilation of what was available - but yes he should have asked first...

You know what that's how this mess all started, making compilations its still modding (puting things together when they were not).

In case of Companies Vs costumers, they can still sue you if you use it non profit, because they can (i.e. money)

In case of costumers Vs costumers (modders), you have to ask first, and usually you'll get a positive answer.

So did Hades asked the guys here at AAA? Did the guys at SAS asked? History SFX? etc..........

I agree if some modders arent content with having their stuff extended to other people in a more reasonable fashion then make the mods for themselves.
I think giving credit to the creator of the mod is more then enough, you all act like he was trying to steal somethin. sheesh...

S~ I happen to know the ONLY person that could sue anyone for any of this is Oleg and the gang, third party mods are just that, they have altered the original retail version in one way or another, third party modders can't receive compensation for someone using their mods, unless it was agreed by the original designer that the mods are an official extension. How do I know this?? Well there was a lil ole game back in the first part of this century called Microsoft Combat Flight Simulator, and there was a mod community around that one too, and an old acquaintance had created a mod to emulate gun smoke befor CFS2 came out with it, and a muldoon took his mod and added somekinda little tweak to it and called it his own, well. my friend was livid and wanted blood, but after contacting Bill Gates and Co., talking to several dozen business and claims lawyers found out the very thing I just mentioned above. Integrity plays on this field, and thats what binds gentlemen to a community like this one, so modders be proud of your work and keep em flyin!!

This is what happened with your topic Pablo:

Circ was notified of it by me, but he was happy with it so I let it go. Rocaskk wasn't, and he was not happy he hadn't been notified so it has been pulled. Until you ask for permission to submit this pack, unfortunately we will have to keep it trashed Sad It's in your hnds now m8 Big Grin And as I've said, the policy of asking authors to post their mods is a much debated one and it isn't without good points on both sides of the argument Big Grin

Make sure you ask all the groups/people whose mods they are so that you can get permission. Also, please make sure the mod is fully working. Get a couple of BETA testers or something, I'm sure some people will be willing to help you out Big Grin

This whole thing is BULL S____

=BLW=PabloSniper Was doing EVERYBODY... YES EVERYBODY here a favor by attempting to combine PUBLICALLY AVAILABLE MODS.. into an easy to use package..

-He did not try to benefit commercially... he provided everything he did for free..

-He did not take credit for anybody's work... In fact he gave due credit..

-Under US copyright laws (And internationals laws I am sure).. what he did is called 'fair and free use' and does NOT need to ask anybody's permission... and this would apply if the material WAS copyrighted... which it isn't.. (This would all be different if was commercially used in any way... which it was not)

I find it VERY IRONIC... maybe even HYPOCRITICAL.. that on a website like this... which arguably began as a portal for illegal hacks to the IL2 series of games.. the very people who hacked IL2 now complain that somehow they were wronged by fair use of what they made available to the public..

Some of these immature egos need to get over it..

I have made many skins and several templates for this game.. and posted them for use... I am NOT surprised when people use them..... and I don't need every user to play 'Hail to the Chief' every time they use the work I made available for everybody.. In a non commercial use..CREDIT or acknowledgment of the original creator is a common courtesy... not some cosmic, all encompassing requirement..

IF YOU DON'T WANT EVERYBODY TO USE YOUR WORK... DON'T POST IT!!!!!!!!

=BLW=PabloSniper Thank you for your effort.. I think you did good!

Fair enough, I'm not arguing that. But we do have to respect the various modders wishes. Anyhoo, I'm sure if you PM pablo he can give you a link to it.

NO... we don't.. legally its public domain if the modder wants to post it for public download.. he can add all kinds of 'restrictions' but legally,..by posting it.. he voids any real claim on Fair Use... In fact, even if it was copyrighted... and he posted it for free use he would have a tough time winning in court..

What If a modder placed a silly restriction that his mods can 'ONLY BE USED IF YOU PLAY IL2 NAKED" are you really seriously saying everybody must 'respect that' ???

IF ANY MODDER DOES NOT WANT FREE AND FAIR USE OF HIS MOD (or more legally stated .. HACK).. THEN HE SHOULD NOT POST IT!!!!!

It's the long term issues. Eventually, from a modders perspective, if people keep on putting your mods in packs without being asked you might annoyed and stop making mods. I know that this has happened to many modders. I respect your opinions and I understand the argument. If you want to get an opinion from the other side, then PM a modder who this counts for and he/they can enlight you on their thoughts Wink

S! beercamel
S! philip.ed

as I said before, the only person who did not accept that I put up their planes in this package was the VHRock, the aircraft it was removed.
and to find the package that I made is very simple.
Go to Ulrapack forum and search for "Unofficial pack for UP 2.0"
this topic is fixed in the forum Ultrapack

Thank you for defending me beercamel

This package works perfectly, do not need beta testers. Big Grin

I've been doing packages since the Ultrapack 1.7

My fisrt pack for UP 1.7

My second pack for UP 1.8
http://il2ultrapack.net46.net/index.php/...l#msg11811

My third pack for UP/HSFX
http://allaircraftsimulations.com/forum/...hp?t=24160

And my last pack for UP 2.0
http://allaircraftsimulations.com/forum/...hp?t=24450 Locked

all work perfectly, just read the replies.

Absolutely true.
The best answer to such a type of complain I've read in years!
My hat off. (BTW, are you a lawyer?)

Cheers!
