It depends on if the video or film is copyrighted.Even if they are I'm not sure just pulling something like the fire effects from a explosion or smoke from a fire would be an infringement.One way to circumvent any problems is to find out who may own the copyright on any video or film you may use and give that said person credit.
Actually, I can't see how you can get into trouble using this type of material. I wouldn't worry about that of I were you. I mean, using it for making special effects for a MOD??? I can't see this as either any financial or artistic infringement.
Surely the individual films in the video are from different sources....do you see what I'm saying 8)

As pistitom says these images are not of anyones creation, nobody created these as special effects they are shot video where as if you so much as combine a few musical notes then you can copyright it, in this case the entire movie can be copyrighted as a creation but the events and content in the movie cannot if that makes any sence as the events are real and were shot at random so lets suppose two people shot the same event who owns the copyright? the answer is they both own the copyright to there own movies if they have applied but not to the events within the movies. Also many of these images are of what people have sent into news stations such as ABC or BBC television and the films have been purchased for a fee to the guy who shot the film, these news agencies dont copyright every scrap of film that is sent to them because its expensive and they serve their purpose very quickly. Another thing, if you found this film on utube and it was copyrighted film then the copyright has already been breached unless the people who own the origanal footage posted the film...... very doubtfull...... i think you'll be ok with this, i'm an artist and have dealt with copyrights and i can't see a problem. For instance i can take a piece of somebodies graphic art and use it as long as i don't portray a direct copy, you will not be making a direct film copy but a special effect of the film and not on camera but proberly using graphics tools.
